These Terms of Use govern your access to and use of the website and online content provided by Cortney Harden, LCSW (“we,” “us,” or “our”). By using this website, you agree to these Terms.
1) Informational Only, Not Medical or Clinical Advice
Content on this website is for educational purposes only. It is not medical advice, mental health advice, diagnosis, or treatment. Do not rely on this website for clinical decisions. Always consult your licensed healthcare professional for guidance specific to you.
2) No Therapist-Client Relationship From Website Use
Viewing the website, sending us messages through forms, scheduling requests, or downloading materials does not create a therapist-client relationship. A therapist-client relationship is formed only after you complete our intake process and sign the required consent documents.
3) Emergencies and Crisis Support
This website is not monitored for emergencies. If you are in crisis or at risk of harm, call 911, contact the 988 Suicide and Crisis Lifeline at 988, or go to the nearest emergency room.
4) Services and Geographic Scope
Clinical services are provided by licensed professionals and only in jurisdictions where they are authorized to practice. Telehealth services are available only to individuals located in states where the treating clinician is licensed at the time of the session. Details are in our client agreement.
5) Age Restrictions
This website is intended for individuals 13 and older. If you are under 13, do not use this site. Parents and legal guardians are responsible for a minor’s use of the site and any submissions.
6) Intellectual Property and Limited License
The website, including text, graphics, logos, images, videos, downloads, and other content, is owned by us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable license to access and use the site for personal, non-commercial purposes. You may not copy, modify, distribute, perform, create derivative works, or exploit any content without prior written consent.
7) User Conduct
You agree not to misuse the site. Prohibited uses include attempting to gain unauthorized access, introducing malware, scraping or data mining, interfering with site operation, or using the site for unlawful, harassing, or deceptive purposes.
8) Third-Party Links and Tools
The site may link to or embed third-party websites, tools, or services. We do not control or endorse third-party content and are not responsible for their practices. Use third-party sites at your own risk and review their terms and privacy policies.
9) Electronic Communications and Security
If you contact us by email, web forms, or SMS, you understand these channels may have privacy and security risks. Do not share highly sensitive information through unsecured channels. Clinical communications, when you are an established client, follow our client communication policies.
10) Privacy
Website privacy practices are described in our Privacy Policy. HIPAA rights and clinical privacy practices are described in our HIPAA Notice of Privacy Practices. These are separate documents.
11) Payments, Digital Products, and Refunds
If the site offers digital products, courses, or events, prices and refund terms will be stated at checkout and in our Financial Policy. Clinical session fees, cancellations, and late-cancellation charges are governed by the client agreement.
12) Insurance and Good Faith Estimates
If you are self-pay or uninsured, you are entitled to a Good Faith Estimate of expected charges upon request and before services. Insurance participation and billing practices are described in our client agreement and may change over time.
13) Disclaimers
The site and all content are provided “as is” and “as available.” We do not make warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the site will be accurate, complete, secure, uninterrupted, or error-free.
14) Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for any claim related to the site will not exceed the greater of one hundred dollars or the amount you paid to us for the site in the twelve months before the event giving rise to the claim.
15) Indemnification
You agree to indemnify and hold us and our officers, directors, employees, and agents harmless from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the site or violation of these Terms.
16) Governing Law and Venue
These Terms are governed by the laws of the State of California without regard to conflict of laws rules. Exclusive venue and jurisdiction are in the state or federal courts located in Sonoma County, California.
17) Changes to the Site and to These Terms
We may update the site and these Terms at any time. Changes take effect when posted with an updated “Last Updated” date. Your continued use of the site after changes are posted means you accept the changes.
